Update on Nitration Mitigation in the Chichester Area

Many developers in the local area will know that we are promoting a Nitrate Mitigation opportunity on behalf of a local landowner farmer near Chilgrove. This will allow developers with a nitrate problem, to essentially transfer their nitrate liability to a landowner, who will undertake all the required mitigation on their behalf by reverting arable land to woodland.

Before opening this opportunity to multiple developers, we have been progressing with a single application in order to assess the process, cost and feasibility of getting the appropriate consents through the local authority (Chichester District Council). The site has received that all-important approval by Natural England and at today's date (9th June 2021) the terms of the s106 agreement are being finalised. If we can be certain that at the end of this process there is a s106 template that can be replicated, with ease, then the landowner will be in a position to progress with multiple mitigation schemes on the same land. We understand that the 17 local authorities in the Solent Area, are currently reviewing a template s106 agreement with the idea being that this process with be streamlined and consistent across the southern region.

This is currently the only nitrate mitigation scheme in the Chichester District that has Natural England approval and is being made openly available. If you are a developer and wish to be informed as when we are ready to proceed with additional mitigations, please email andrew.thomas@henryadams.co.uk
